COCOO.uk is launching a compensation campaign to investigate potential claims for parties who believe they have been harmed by the alleged anti-competitive conduct of British Steel, particularly under its ownership by Jingye Group, prior to the government’s intervention with the Steel Industry (Special Measures) Act 2025. Potential affected parties are primarily downstream customers reliant on steel from British Steel, such as those in the construction, manufacturing, automotive, or energy sectors, who may have suffered economic loss due to British Steel’s alleged market behaviour while under Jingye’s control. COMMON HARM

The common harm under investigation is the economic damage potentially inflicted upon businesses as a result of alleged abuses of a dominant market position by British Steel (under Jingye). This could manifest as artificially inflated prices for steel products, reduced availability of essential steel supplies due to strategic limitation of production, or unfair trading conditions imposed upon customers who had limited alternative sources for certain types of steel, particularly primary steel produced via blast furnaces in the UK where British Steel may have held a near-100% market share

WHY THIS CAMPAIGN IS CRUCIAL
This campaign is necessary because COCOO.uk has significant concerns that British Steel, while controlled by Jingye Group and prior to the enactment of the Steel Industry (Special Measures) Act 2025, may have engaged in conduct that abused a dominant market position. Such alleged conduct could include threatening closures or refusing to supply essential steel products as a tactic to extract financial support or impose unfair terms, or strategically limiting production. COCOO.uk has formally raised these concerns with the UK’s Competition and Markets Authority (CMA), urging an investigation into Jingye’s practices. If such anti-competitive behaviour occurred, affected businesses may be entitled to compensation for the losses incurred. This campaign seeks to identify these businesses and explore collective avenues for redress

ACTUAL AND POTENTIAL HARM

Potential causes of action primarily centre on infringements of Chapter II of the Competition Act 1998, specifically the abuse of a dominant position by British Steel (under Jingye). The perjuicios, or harms, that affected businesses may have suffered include, but are not limited to: financial losses due to paying excessive prices for steel products; increased operational costs or lost profits resulting from disruptions in supply or the imposition of unfair trading conditions; and damage to commercial viability or competitiveness from having to operate under terms dictated by an allegedly dominant supplier
